Okay, a show of hands: how many suspected from the start that Gabriel Hicks was the murderous psycho Tobias Fornell thought him to be? Following on a bland, unremarkable story and a truly bad one, NCIS managed possibly the best episode of the season so far with "Burden of Proof. Fornell's always been a personal favorite of mine. He appeared all the way back in the first episode of the series when Gibbs actually stole a body and Air Force One! Joe Spano and Mark Harmon play so well off each other, don't they?

A new investigation into an old case drives a wedge between Gibbs and Fornell. It's always a pleasure to watch NCIS when it's firing on all cylinders, and tonight, those cylinders were all engaged. The team takes on the case of Gabriel Hicks, who's a decade into a death sentence for murdering Lt. Edward O'Connell. Mark Mason, the NCIS agent who worked the case, died five years ago, so Gibbs takes the lead in the new investigation in advance of Hicks' retrial. However, the evidence against Hicks was all circumstantial: He drove a blue van, was found in possession of cash, and lied about his alibi that night. The best witness, a woman selling fruit near the bank, was never found. Although Hicks' attorney, federal public defender Jessica Schafer, finds no evidence of a frame job, she does ask Ducky to return to town to review the original case notes and O'Connell's exhumed body. Ducky was out of town during the initial autopsy, which was handled by a city ME. Ducky and Palmer confirm death by blunt force trauma, but the body's deteriorated condition tells them something new: O'Connell was killed while kneeling, but the fatal blow was delivered by a left-handed swing. And Hicks? You guessed it; he's a righty. A familiar face worked the case for the FBI 11 years ago: Fornell! Over lunch, he declares Hicks as guilty as they come, although Gibbs remains unconvinced, particularly because of the left-handed murder by a right-handed man. When Torres and McGee examine the original murder scene, they discover new evidence.

Ducky's new autopsy, however, reveals that the lieutenant was killed by a left-handed blow, and Hicks is right-handed, so the team delves further. They search for a missing witness who could identify, or at least describe, the person who kidnapped the lieutenant. When they do locate her, however, she describes the suspect as black, not white like Hicks -- and she says that she told all this to Fornell a decade ago. Fornell admits that he did interview her but covered up the evidence because his gut told him that Hicks was guilty and that the witness was coerced into lying. When Gibbs is put on the stand by Hicks's lawyer, he tells what the witness told him, and Hicks is released from jail while Fornell faces dire professional and personal consequences.
